1. Agreement to Terms

By accessing our website www.aiplanthire.co.uk ("Site") and using our services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you disagree with any part of the terms, you may not access the service.

2. Hire Agreement

All equipment hires are subject to the CPA (Construction Plant-hire Association) conditions, which are made available during the checkout process and are incorporated by reference into these Terms. By placing an order, you confirm that you have read, understood, and agree to be bound by the CPA Consumer Conditions of Hire or CPA Model Conditions as appropriate for your customer type.

3. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Bookings, Payment, and Cancellation

All bookings are subject to equipment availability and our acceptance. We reserve the right to refuse or cancel any order at our discretion.

• Payment: All prices are in GBP and exclusive of VAT unless stated otherwise. Full payment is required at the time of booking through our secure third-party payment processor, Stripe.
• Cancellation: You may cancel your booking via your user account page. Cancellations are subject to the terms outlined in the CPA hire agreement, which may include cancellation fees depending on the notice period.

5. Your Responsibilities

• Equipment Inspection: Upon delivery, you are responsible for visually inspecting the equipment for any damage or operational issues before use. Any discrepancies must be reported to the delivery driver and our office immediately.
• Safe Operation: You agree to operate the equipment in a safe, competent manner, in accordance with the manufacturer's user manual and our on-site safety guides. You must ensure that only trained and authorized persons operate the machinery.
• Site Conditions: You are responsible for ensuring the delivery site is safe, accessible, and has suitable ground conditions for the operation of the equipment. Any costs incurred due to unsuitable site conditions will be your responsibility.
• Return Condition: Equipment must be returned in the same condition it was delivered, allowing for normal wear and tear. Charges will apply for excessive cleaning, refueling, or any damage beyond fair use.

6. Limitation of Liability

To the fullest extent permitted by law, Ai Plant Hire Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, resulting from your use of our services or equipment. Our total liability for any claim arising out of or relating to these Terms or our services is limited to the total amount you paid for the hire in question.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales.
